Larned man sentenced to prison time on indecent liberties charges

postA Pawnee County District Judge Friday sentenced a Larned man to 5 ½ years in prison for aggravated indecent liberties with a child.  District Judge Bruce Gatterman sentenced 45-year old Dale Horton to prison on the charges that could have brought more jail time had the judge not deviated from state sentencing guidelines.

The 5 ½ year sentence for Horton is 20 years less than mandated by Jessica’s Law, which requires 25 years to life in prison for sex crimes involving a child under 14, without the possibility of parole for 25 years.

In a press release, Gatterman cited the lifetime registration requirements under the law, the fact that Horton’s plea eliminated the need for the victims to testify and the lack of prior criminal history as the reasons for departing from state sentencing guidelines.

According to the criminal complaint, the incidents with the victims took place sometime between September 2010 and January 2011.

  1. Fantastic. The pedifile will be out in time to do damage to some other kids. ‘incidents with the victims’ / ‘between September 2010 and January 2001’? Geesh, how many children were involved here? Sounds rather ‘serial’ to me. Wonder if such a tough sentence would of been the same if it were a judge’s kid involved. Next time, judge, don’t be so harsh. The victims were only kids. No wonder this trash continues in our society.

    • Have you considered he was falsely accused? I know him and he did not do it. It’s SRS who is after his kids. It’s trash talkers like you that make out society worthless. This makes me ashamed to be an American. While they are falsely accusing innocent people, the real pedopiles are getting away with more and more. And if this post gets deleted, I will habe my freedom of speech right violated. Americans now days are hypocrites.

  3. I know Dale did not do this. I’m his wife & the kids r ours my oldest son & daughter was promised expensive gifts if they said wat Kansas DCF & St Francis told them to say. If any one was in the court room when the sentence went down would know he did not get 5 1/2 yrs he got 3 1/2 yrs. If any one wants to say bad things about my husband they better think twice. I have known Dale when we started dating in Dec of 2001 & we got married after our first son was born in Dec of 2004 every time we heard or seen something in the news about something like this he wanted to go right through the TV & hurt the guy, I have several nieces that if he suppose to be this kind of man then he would of done it to them, but of course he did nothing why would someone do it when their wife is right there. So before anyone wants to bad mouth Dale they better get the facts right before they post anything. If my post gets deleted trust me I will keep posting the facts that I know when I was in the court room & I talked to his lawyer. If anyone wants to slander his name I promise u u will be sued by me .

Then this testimony should of been seriously considered. Since DCF, St. Fran and the witnesses conspired, there’s the suits to filed.
    What expensive gifts did the DFC and SF give the children? It’s evidence the Ks. AG should then be aware of.
    ‘they better get the facts right before they post anything’ Who wrote the article? Another possible suit if the facts are incorrect and the article is not retracted or corrected.
    If the crimes were not committed, all is correct in the above, including the proof of expensive gifts, then a conviction should be overturned. If not, …

I DO NOT KNOW ANYONE IN THIS CASE OR THE CASE INFO, BUT I DO WANT TO SAY THAT MY HUSBAND HAS BEEN FALSELY ACCUSED AND CONVICTED AS WELL IN A DIFFERENT CASE WHICH HAD ABSOLUTELY NO EVIDENCE OTHER THAN TESTIMONY. IT IS A SHAME AND DISGRACE THAT INNOCENT PEOPLE ARE CONSTANTLY BEING ACCUSED AND CONVICTED BECAUSE IN THESE TYPE OF CASES YOU ARE NEVER INNOCENT UNTIL PROVEN GUILTY, YOU ARE ALWAYS GUILTY FIRST! THERE IS NO JUSTICE SYSTEM WITH THESE KINDS OF CASES! IT HONESTLY HURTS MY SOUL TO SEE MY HUSBAND SUFFER LIKE THIS AND TO HEAR ABOUT OTHERS AS WELL.
